TERMS AND CONDITIONS
This document sets out the terms of use for the website www.terranebags.com, as well as the terms and conditions for purchasing products through it (hereinafter referred to as the "General Conditions").
Our Privacy Policy and Cookie Policy are also an integral part of these General Conditions.
Accessing and browsing this website, or using its services, implies full and express acceptance of these General Conditions and the documents mentioned herein. Therefore, we recommend that you read them carefully. If you do not agree with their content, you should not use this website. If you have any questions about the General Conditions or the Privacy and Cookie Policies, you can contact us through any of the means described below.

By using our website and placing orders through it, you agree to:

It is also expressly prohibited to introduce hyperlinks for commercial purposes on websites not owned by TERRÁNE that allow access to our website, without prior consent.
The existence of hyperlinks on third-party websites does not in any case imply the existence of commercial or business relations with the owner of the website where the hyperlink is established, nor acceptance by TERRÁNE of its content or services.
The User shall be liable for any damages of any kind that TERRÁNE or any third party may suffer as a result of a breach of any of the obligations to which the User is subject under these General Conditions or the law in relation to access and/or use of this website.
3. SERVICE AVAILABILITY
The items offered through the website www.terranebags.com are available for the following territories: Europe, America, Australia, and Asia, except for Russia and North Korea.
4. ORDERS
To place an order, you must follow the online purchase process and click on "Authorize payment." If your offer is accepted by TERRÁNE, you will receive an email confirmation that your order has been processed ("Order Confirmation"). You will also be informed by email when the product has been shipped ("Shipping Confirmation"). The contract for the purchase of a product will only be formalized when we send you the Shipping Confirmation.
Although we will do our best to process all orders, there may be exceptional circumstances that force us to refuse to process an order after sending the Order Confirmation, and we reserve the right to do so at any time, at our sole discretion. If your offer is not accepted and payment has already been charged to your account, the full amount will be refunded.
By placing an order, you confirm that all the information and personal data provided is true and accurate, and that you authorize us to charge the corresponding card (credit or debit) and that there are sufficient funds in the account to cover the cost of the order.
5. PRICE
The price of the products will be as stated on our website at any given time, except in the case of an obvious error. These prices may change at any time, but any changes will not affect orders for which we have already sent a Shipping Confirmation. Prices shown on the website include VAT but exclude shipping costs, which will be added to the total amount due.
6. SHIPPING
Orders are prepared within 1 business day and shipping takes 1–2 business days within Spain, and 4–8 business days for other delivery countries depending on the destination.
All orders placed after 12 p.m. will be processed the following business day. Public holidays do not count as delivery days, and orders placed on public holidays will be counted as placed the next business day. Actual delivery dates may be affected by shipping delays due to weather conditions or other external factors, as well as during peak seasons. Please check the shipping tracking information sent via email for the most accurate delivery estimate.
The total shipping cost will be automatically calculated and detailed at the time of confirming the purchase.

7. RIGHT OF WITHDRAWAL
Requests for exchanges and returns must be made within 15 calendar days from the delivery date.
Exchanges and returns must be requested by email at info@terranebags.com. The customer is responsible for the cost of return shipping in these cases, except for customers located in mainland Spain and the Balearic Islands, where the first exchange or return is free.
Requests for full refunds must also be sent to info@terranebags.com. In such cases, the purchase amount will be refunded once the returned product is received in perfect condition at the aforementioned address. Shipping costs, however, will not be refunded.
Products for which exchange or return is requested must be in perfect condition, meaning unused, with all original tags, and in the same packaging in which they were delivered.
TERRÁNE reserves the right to reject a return if any of the above conditions are not met. In such cases, you will be notified by email that your order is not eligible for return.
8. PRODUCT AVAILABILITY
All orders are subject to product availability. In case of supply difficulties, we will refund any amount you may have paid.
9. WARRANTIES
If you are contracting as a consumer and user, we offer warranties on products sold through this website, under the terms legally established for each type of product, covering any non-conformity within three years from delivery.
Products are considered to conform to the contract if they match the description given by us, possess the qualities we have presented on this website, are fit for the usual purpose of goods of the same type, and show the quality and performance that can reasonably be expected. If any product does not conform to the contract, you must inform us immediately via our contact channels, providing product details and the damage suffered. Amounts paid for products returned due to a defect or fault (once verified by TERRÁNE) will be fully refunded using the same payment method used for the purchase.
10. LIABILITY AND DISCLAIMER
Unless expressly stated otherwise in these General Conditions, our liability for any product purchased on our website is strictly limited to the purchase price of the product.
However, and unless otherwise provided by law, we will not be liable for the following losses, regardless of their origin:

Due to the open nature of this website and the possibility of errors in the storage or transmission of digital information, we do not guarantee the accuracy and security of information transmitted or obtained through this website, unless expressly stated otherwise.

All content published on this website — particularly designs, texts, graphics, logos, icons, trade names, trademarks, and other elements that may be used commercially or industrially — are subject to intellectual and industrial property rights held by TERRÁNE or third parties who have authorized their inclusion. No license or waiver, full or partial assignment of said rights, or the granting of any rights or expectation of rights is granted to the User. The exploitation, modification, reproduction, distribution, or public communication of such rights is expressly prohibited without prior written authorization from TERRÁNE or the corresponding right holders.
12. WRITTEN COMMUNICATIONS
Applicable law requires that some of the information or communications we send you be in writing. By using this website, you accept that most communications with us will be electronic. We will contact you by email or post notices on this website. For contractual purposes, you consent to this electronic means of communication and acknowledge that all contracts, notifications, information, and other communications provided to you electronically comply with legal requirements to be in writing. This condition does not affect your statutory rights.
13. VIRUSES, HACKING AND OTHER COMPUTER ATTACKS
You must not misuse this website by intentionally introducing viruses, trojans, worms, logic bombs, or any other technologically harmful or damaging programs or material. You must not attempt to gain unauthorized access to this website, the server hosting it, or any server, computer or database connected to our website. You agree not to attack this website via a denial-of-service attack or a distributed denial-of-service attack.
Breaching this clause could result in legal violations and will be reported to the competent authorities. In such cases, you will immediately cease to be authorized to use this website.
We will not be liable for any damage or loss resulting from such attacks that may affect your computer, IT equipment, data or materials due to your use of this website or your downloading of any content from it or to which it redirects.
14. TRANSFER OF RIGHTS AND OBLIGATIONS
The contract is binding for both you and us, as well as for our respective successors, assigns, and heirs. You may not transfer, assign, encumber, or otherwise dispose of a contract or any of your rights or obligations under it without our prior written consent. We may transfer, assign, encumber, subcontract, or otherwise dispose of a contract or any of our rights or obligations under it at any time during the term of the contract. For the avoidance of doubt, such transfers will not affect your legal rights as a consumer or cancel, reduce or limit in any way the warranties we may have provided to you.
15. EVENTS BEYOND OUR CONTROL
We will not be liable for any failure or delay in fulfilling any of our obligations when caused by events beyond our reasonable control (“force majeure”), including but not limited to:

Strikes, lockouts, or other industrial action;

Civil unrest, riots, invasion, terrorist threat or attack, war (declared or not), or threat or preparation for war;

Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster;

Impossibility of using railways, shipping, aircraft, motor transport, or other means of transport, public or private;

Impossibility of using public or private telecommunications networks;

Acts, decrees, legislation, regulations or restrictions of any government or public authority.
Our obligations shall be suspended during the force majeure period, and we will be granted an extension equal to the duration of the force majeure. We will use reasonable efforts to bring the force majeure situation to an end or find a solution enabling us to fulfill our obligations.
16. WAIVER
Failure on our part to require strict performance by you of any of your obligations under any contract or these General Conditions, or failure to exercise any rights or remedies to which we are entitled under such contract or these General Conditions, shall not constitute a waiver of such rights or remedies or relieve you of such obligations.
Any waiver by us of any provision of these General Conditions or of any rights or remedies under a contract shall be effective only if it is expressly stated to be a waiver and communicated to you in writing.
17. SEVERABILITY
If any of the provisions set forth in these Terms and Conditions are declared invalid, illegal or unenforceable by the competent authority, such provision shall be deemed severed from the remaining provisions, which shall remain valid and enforceable to the fullest extent permitted by law.
18. ENTIRE AGREEMENT
These Terms and Conditions, along with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and TERRÁNE in relation to the subject matter hereof and supersede any prior understandings, agreements or statements, whether oral or written.
19. RIGHT TO MODIFY THESE CONDITIONS
We reserve the right to revise and modify these Terms and Conditions at any time. You will be subject to the policies and Conditions in effect at the time you use this website or place an order, unless changes are required by law or decision of governmental authorities, in which case they may also affect orders previously placed.
20. APPLICABLE LAW AND JURISDICTION
The use of our website and the contracts for the purchase of products through it shall be governed by Spanish law. Any dispute arising from or relating to the use of the website or such contracts shall be subject to the non-exclusive jurisdiction of the courts and tribunals of the city of Málaga, Spain.
If you are contracting as a consumer, nothing in this clause shall affect your rights as recognized by current consumer protection legislation in your place of residence.
